We don’t like rules any more than the next guy, but our lawyers say we need to have some in place., we know, but necessary never the less. 

 

So without further ado, here are the Service Specific Terms, hereafter referred to as “Service Specific Terms”, that define the relationship between “You” and Decoded Solutions, LLC, hereafter referred to as BrandBoostr, “Us”, “We” or “Company”. 

 

These terms, will help you understand the rules and terms that govern the access, use or purchase of services on the website, hereafter referred to as “Site”, and our services, products, or other offerings, hereafter referred to as “Services”.


By using, accessing, or participating in our Site or Services you hereby agree to be legally bound by these “Service Specific Terms” and our “Terms of Service”.

Welcome to the Rulebook!

Otherwise known as the “Service Specific Terms” for BrandBoostr and associated Services.

 

By using our Site or Services you hereby agree to these terms. We ask (pretty please) that you read these terms carefully as they impact and dictate the relationship between you and Us.

 

If for any reason you are in disagreement with any of these terms, then you are not authorized nor allowed to use or access our Site or purchase or use our Services.


Due to the robust selection of offerings and/or Services on our Site, each of our Services may have its own terms and conditions called “Service Specific Terms” that are in ADDITION and ADDITIVE to our Terms of Service. Agreeance to these terms in full is required as a mandatory requirement for using or accessing our Services. 


In the event that these Service Specific Terms conflict in any way with the terms of another Service or product offering, the terms of that specific Service or product shall prevail to the extent of the difference between the Service Specific Terms. 

 

Please note that these Service Specific Terms may be updated at any time with or without notice at the sole discretion of our Company, and that any such changes shall take place immediately upon publication of such to this page.

1. Content Writing Terms

CONTENT MAREKTING AND OPTIMIZATION

Although our services often result in substantial increases in ranking, exposure and web traffic, due to the complex and ever-evolving nature of search engine algorithms we cannot guarantee any particular ranking or outcome.

Further, there may be circumstances or actions that You take as a customer which have a negative impact on desired results. For example, we may write or optimize high-performing content, but a negative SEO attack against you, or addition of toxic backlinks, or other optimization penalties may impact the ability of our content efforts to perform as intended.

SEO is a process that takes time, with results generally getting better the longer optimization activities have taken place. Although results can somtimes be seen within a few days, often times Google rewards “aged” content to a greater degree, and as such it may take up to 4-12 (or more) weeks to see the full effect of your efforts and/or purchased products or services.

 

In the event that backlinks are part of your content marketing Service, you hereby agree that according to Google Webmaster Terms any intentional efforts to earn backlinks for the purposes of search engine optimization is against their terms and may result in negative actions against your website including but not limited to temporary or permanent decreases in ranking, manual site actions, and in rare circumstances de-indexation. You further agree that We are not responsible for, nor are to be held accountable in any way for any damages or losses, direct or indirect, of any kind, under any theory of law that are caused by or related to any drop in rankings of your site or web property being promoted or linked to by us. You also acknowledge and agree that there is no clear way to determine whether or not any decrease in ranking is or was due to any actions taken by Us, and that the very nature of Google’s algorithm is unpredictable, volatile and not well-understood.

 

According to Google, any link building efforts with the intent of increasing ranking, including legitimate white hat guest posts is against their guidelines. As such, you hereby acknowledge and agree that link building of any nature or type comes with a certain level of inherent risk. By hiring us for link building or related services, you hereby accept that risk as your own.

 

REVISION POLICY


Unlimited FREE content revisions are included on all content writing packages for:

  1. Any item explicitly asked for in the instructions, that falls within the scope of your purchase, which Our team failed to include or follow; and
  2. Any grammatical errors 

In addition to revision items (1) and (2) above, we allow for up to three minor “line edit” revisions and/or revisions to formatting. These types of revisions involve phrase edits to selected sentences, but do not include an entire rewrite of sections or pages of an order. Each of the three allowable line edit submissions may ask for multiple edits per submission.

Requests for revisions must be made within 5 business days of delivery. Revision requests past this date will be considered on a case by case basis at our discretion. Once revisions have been approved by You, no further revisions can be made. 


COPYSCAPE POLICY


Due to the technical limitations of CopyScape, we allow a small margin of duplicate content to be accepted. This generally is under 5%.

Here are a few examples of where a limited amount of duplicate content is unavoidable:

  • Reference of a product, brand name, SKU
  • Reference of a company’s or brand’s official slogan, tagline or trademark
  • Reference of a quote or statistic from an authoritative source (such as Forbes)

Any purchased content with a higher than 10% CopyScape score may be submitted to Us for validation of, and subsequent rewriting of the copied portion of the content at no additional cost to you. 

 

We will NOT accept any proof of “duplicate content” other than CopyScape as other services are often unreliable or are subject to manipulation.

 

Fraud Prevention and CopyScape Claim Deadlines

 

Due to the complex nature of proving the publication dates of online content, any such replacement request on the basis of “copied” or “duplicate” content must take place within 24 hours of content delivery by Us to You. 

 

This time restriction is meant to prevent fraud against our company. For example, a buyer may try to defraud us by purchasing an article, posting it on a site, web 2.0 property, as a guest post, or distributing it for their benefit, and then subsequently claiming it is duplicate content already existing online once CopyScape crawlers have indexed it.

2. Search Engine Optimization Terms

LINKS / LINKBUIDLING / BACKLINKS

Ranking Results

 

We have a lengthy track record of providing immense value, ROI and performance minded services that help our customers grow their businesses. However, although our services often result in substantial increases in ranking, exposure and web traffic, due to the complex and ever-evolving nature of search engine algorithms we cannot guarantee any particular ranking or outcome. 

 

SEO is a process that takes time, with results generally getting better the longer links and other activities have taken place. Although results can often be seen within a couple short weeks, often times Google rewards “aged” links more and as such it may take up to 4-12 weeks to see the full effect of your efforts and/or purchased products or services.

Further, there may be circumstances or actions that You take as a customer which have a negative impact on desired results. For example, we may provide high quality backlinks that would have otherwise boosted rankings, but duplicate/thin content, poor on-page optimization, or other issues could hinder our services from performing as well as intended. 

 

Google Webmaster Guidelines Regarding Link Building 

 

You hereby agree that according to Google Webmaster Terms any intentional efforts to earn backlinks for the purposes of search engine optimization is against their terms and may result in negative actions against your website including but not limited to temporary or permanent decreases in ranking, manual site actions, and in rare circumstances de-indexation. 3. Press Release Terms

A. Accuracy, Authenticity and Intellectual Property 

By providing or submitting content to Us in any form or medium intended for use or publication you hereby acknowledge and agree that you and you alone are solely responsible for both its authenticity and accuracy. This includes information provided to us by you including but not limited to images, videos, graphics, documents, contact details, and more.

 

You hereby acknowledge and agree that you and you alone are solely responsible for NOT violating any trademarks, infringing on copyrights, intellectual property, personal privacy or any other applicable laws or regulations.

 

 

B. Editorial Guidelines

By ordering any of our press release or media packages you hereby acknowledge and agree to the following stipulations and all individual requirements necessary to comply with in order to get your content published on each individual media or news site.

 

Many media and news sites have their own individual restrictions and editorial requirements. We do NOT have editorial control over other third party websites, media and news channels, and as such, there may circumstances where content needs to be modified in order to meet their individual standards.

 

 

For example, there are generally limitations regarding:

 

 

  • Length of the content (minimums and maximums)
  • Maximum character limits for headings / headlines
  • Restrictions on promotional terminology and verbiage
  • Topical restrictions (i.e. should be “newsworthy”)
  • Maximum number of hyperlinks, images, videos and media that can be included
  • Cannot be overtly advertorial (i.e. cannot be a sales page)
  • Must be written in the THIRD person. Cannot use “I”, “We”, “Us”, “You”, “Your”, etc.

Media Engage

 

We have more leeway with topics for our media engage packages and these may often be approved for “non-newsworthy” topics such as guides, informative content pieces and more on a case by case basis.

 

 

Our Media Engage service utilizes the Google Maps API in order to correctly embed and place Google Map locations for those customers that have a physical address and who wish to have their Google My Business (GMB) included in the release. In the event that Your GMB is not in Google’s official GMB API we may not be able to correctly display you map or include your map at all.

 

 

In some cases a Service Area GMB will not show up in the Google Map API, but Your individual location/address may. In such cases we will revert to including a map of your singular address but NOT the Service Area Business map. 

 

 

C. Authorization to Send to Publication 

We do not send any content off for publication on any site without your permission and authorization to do so. This authorization may be provided via email, chat message, via your client portal, within our project management system, via a support ticket or any other electronic means of communication that we approve of for the purpose of documenting your “authorization” to proceed with publication of the content.

 

 

In the event that You are using or accessing our Services or Site on behalf of another entity or business, that entity or business hereby accepts these terms and you hereby warrant that you have the proper authorization and authority to bind the entity or business to these terms. In the event that you do not have the appropriate authority to bind such a business or entity to these terms, then you may not purchase or use the Services of our Site acting as or on behalf of said business or entity. 

 

 

D. Editorial Approval for Publication

We do not own news or media networks such as FOX, CBS, ABC, etc. As such, we have no direct or third-party control over their actions or editorial approval of your content or release. 

 

 

There may circumstances where content needs to be modified in order to meet their individual standards at their request. When this happens we will inform you, made such edits, and return the edited work to you for review and re-authorization for us to send the amended work off to publication again.

 

 

In rare circumstances or when dealing with restricted niches, there may be cases where a release is outright denied for publication altogether. If this is the case we will refund you in full for your purchase. In such cases you hereby agree that a refund in full is the full and sole remedy for this situation.

 

 

E. Edits, Stop and Removal Requests (once published)

 

The process and ability for us to make edits or to takedown/remove a press release after publication varies depending upon the service in question.

 

 

I. Media Engage 

Please note that any edits requested that are the result of customer error or omission as determined at our sole discretion are subject to a $79 fee for removal, editing, and republication. For example, a typo or omission on the order form filed out by you is something we could not have known was an error. The fee for takedown requests of this service is $59. 

 

 

Stop Requests  

 

In some cases, there may be a window of time where we may be able to “stop” a press release that is “under review” by media editors but has not yet hit various newswires or sites. If you need to submit a stop request after approval of content but before publication, please do so as quickly as possible.

 

 

However, because the window of time available for “stoppage” is SMALL, we cannot, nor do we guarantee, that we will be able to process your Stop Request before publication.

 

 

Requests for stop orders are free for customers. 

 

 

Edit Requests  

 

 

NOTE: Although most (if not all) news and media sites under this package honor our requests for edits/updates and republication, we cannot and do not guarantee that any requested edit will be published or updated by any particular site or sites. You hereby acknowledge and agree that we do not have any control over any third party site your release is published on, and that their failure to honor a request you may make for edits is not our fault, nor shall we be held accountable for their failure to remove your release from their site, in any way, under any theory of law.

 

 

Generally Allowable Edits we Can Submit for Review Include:

 

 

    • Company name 
    • Company address
    • Company website
    • Company phone number
    • Media contact name
    • Company logo, images and any included videos
    • Google MAP
    • Hyperlinks
    • Body text of the release

 

What Cannot be Sent for Editing:

 

 

    • Update to the title of the press release
    • Update to the main and subheading of the press release

 

Removal Requests

 

 

NOTE: Although most (if not all) news and media sites under this package honor our requests for a takedown or removal of a release, we cannot and do not guarantee that any requested removal will be carried out by any particular site or sites. You hereby acknowledge and agree that we do not have any control over any third party site your release is published on, and that their failure to honor a request you may make for removal is not our fault, nor shall we be held accountable for their failure to remove your release from their site, in any way, under any theory of law. 

 

 

NO GUARANTEE OF REMOVAL: WE DO NOT CONTROL THIRD PARTY SITES. SOME MEDIA, NEWS AND OTHER SITES DO NOT ACCEPT REMOVAL REQUESTS. AS SUCH, WE CANNOT AND DO NOT GUARANTEE THAT PURCHASE OF OUR REMOVAL SERVICE WILL RESULT IN ANY OR ALL SITES TAKING DOWN YOUR PRESS RELEASE. 

 

 

IN THE EVENT THAT A REMOVAL REQUEST IS NOT AN OPTION, SOME SITES WILL ALLOW PUBLICATION OF AN ADDITIONAL PRESS RELEASE TO AMEND OR CORRECT THE PREVIOUSLY PUBLISHED INFORMATION TO MORE ACCURATELY REFLECT YOUR INTENTION. THIS SERVICE CAN BE PURCHASED FROM US WHEN AND WHERE AVAILABLE. 

 

 

II. Media Newswire 

The fee for removal requests of this service is $199-$499 determined on a case by case basis. The cost for re-publication with edits is $59.

 

 

Stop Requests  

 

 

In some cases, there may be a window of time where we may be able to “stop” a press release that is “under review” by media editors but has not yet hit various newswires or sites. If you need to submit a stop request after approval of content but before publication, please do so as quickly as possible.

 

 

However, because the window of time available for “stoppage” is SMALL, we cannot, nor do we guarantee, that we will be able to process your Stop Request before publication.

 

 

Requests for stop orders are free for customers. 

 

 

Edit Requests  

 

 

News and media publications do not allow edits once the release has been published. In the case edits are needed the only other option is to order a takedown request, have the edits made, then re-submit for publication. In the event that you need to republish an edited release we will reduce the fee to $59 for re-publication.

 

 

Removal Requests

 

 

NOTE: Although most (if not all) news and media sites under this package honor our requests for a takedown or removal of a release, we cannot and do not guarantee that any requested removal will be carried out by any particular site or sites. You hereby acknowledge and agree that we do not have any control over any third party site your release is published on, and that their failure to honor a request you may make for removal is not our fault, nor shall we be held accountable for their failure to remove your release from their site, in any way, under any theory of law. 

 

 

In the event that you need to submit a removal request, we will make a good faith effort to work with our media partners to get your press release removed. This service is available only under exceptional circumstances, determined at our sole discretion, and will be billed for an additional fee, the rate of which will be determined on a case by case basis ranging from $199-$499.

IN THE EVENT THAT A REMOVAL REQUEST IS NOT AN OPTION, SOME SITES WILL ALLOW PUBLICATION OF AN ADDITIONAL PRESS RELEASE TO AMEND OR CORRECT THE PREVIOUSLY PUBLISHED INFORMATION TO MORE ACCURATELY REFLECT YOUR INTENTION. THIS SERVICE CAN BE PURCHASED FROM US WHEN AND WHERE AVAILABLE. 

 

 

F. Restricted Industries and Topics

Our rules regarding “Restricted Industries” and topics apply to all of our press services.

 

 

We reserve the right to decline orders, at our sole discretion, for any topics that we deem offensive or that involves, promotes or incites hate, violence, discrimination, or any illegal activity. 

 

 

Further, many media and news sites have their own individual restrictions on topics. We do NOT have editorial control over other third party websites, media and news channels, and as such, there may be topics that we are unable to promote depending on the specific service or package you have purchased.

 

 

BrandBoostr reserves the right, at our sole discretion, without explanation, to refuse orders for any service or offer to promote, support, or work on or with any business that has content associated with or is deemed to be:

 

 

  • Libelous in Nature
  • Has harmful intent
  • Consists of sexually explicit topics or material
  • Involves litigation or legal cases
  • Promoting unsafe or dangerous products, services or supplements
  • About online pharmaceuticals or drugs
  • About making money or MLM schemes
  • Promoting or disseminating false information
  • Related to gambling
  • Related to Payday loans
  • Involving unverified celebrity endorsements 
  • About cryptocurrency 
  • Outright SPAM
  • Promoting or informing about investments, partnerships, business deals, acquisitions, venture capital or private equity
  • Copied news or material (i.e. plagiarized)
  • Stock or investment recommendations
  • Opinion pieces on publicly traded companies 
  • Pirated or unauthorized premium video streaming or download sites
  • Blackhat SEO or marketing
  • Guns, weapons, ammunition
  • Anything that is or promotes anything illegal

If you have concerns about your niche or topic, reach out to our team for advice and help formulating a plan and evaluating what we can and cannot get published for you. In some cases we may be able to find unique approaches to helping you get published on a case by case basis.

4. Lead Generation

YOUR USE OF LEADS / DATA FROM BRANDBOOSTR

Unless otherwise specified in your purchase agreement, you hereby acknowledge and agree that you are responsible for:

  • DNC filtering
  • Data cleaning
  • Following CAN-SPAM regulations
  • Familiarizing yourself with and following any laws or regulations relevant to your industry
  • Comply with all laws and regulations regarding your use of or marketing to leads or data
  • Abide by TCPA laws

You agree that your use of data shall be restricted to only those activities or usages that are within your legal right to conduct and that any and all of your activities or usages of such data, leads or Services provided to you by BrandBoostr or our partners will comply with any and all applicable laws and regulations to your industry.

 

RIGHT TO RESELL LEADS/DATA

Unless approved in writing by BrandBoostr, you may NOT re-sell leads or data that is provided or sold to you by Us. You hereby agree that you or your company is the “end user” of such leads and data and that such leads and data will not be shared, sold or traded with any other third party without the express written permission of BrandBoostr.

 

DATA / LEAD VALIDATION

You hereby acknowledge and agree that unless specified, all leads generated are NOT validated, nor confirmed for working email addresses, phone numbers etc. The information on all leads is made available based on what the prospect typed into the long or short form online when filling out a lead gen or other form or as provided by them via other means, or as collected by Us.

As such, a typo by the prospect would result in an incorrect data point. In some cases prospects do NOT include their “real” phone number or name on a form if all they want is “information” and not to be contacted by a “sales rep”. 

Validation of contact information can, in some cases, be purchased from Us for an additional fee. Due to the nature of leads and information, we often “over-deliver” so as to make up for any invalid information or data.

 

EXCLUSIVITY  

You agree that requests for price quotes or information made on sites NOT in control by BrandBoostr may result in the sale of that consumer’s or business’s information to MULTIPLE buyers or distribution networks (such as affiliate networks). 

For example, if a prospect fills out a lead form on one of our controlled properties, but then does the same thing on another website NOT owned or controlled by us, that other website may sell that information to one or multiple lead buyers. As such, we cannot guarantee that the leads are exclusive. Because of this we always recommend making contact with the prospect as soon as possible.
